• Emergency Roadside Assistance Reminder: It has been brought to our attention that unauthorized individuals have attempted to offer roadside assistance to drivers on the 66 Express. Only clearly marked 66 Express vehicles or official emergency responders (such as police, fire, or EMS) are authorized to assist on the Express Lanes. Our roadside teams are always in uniform, vehicles are clearly marked, and we will never ask for payment.

Privacy Policy

Effective as of July 1, 2025

I-66 Express Mobility Partners, LLC (“EMP”, “we”, “us”, or “our”) respects your privacy and is committed to maintaining it through adherence to this privacy policy (this “Policy”). EMP has developed this Policy to describe:

  • What Personal Information we may obtain through your interactions with us on our toll road, on our website (https://ride66express.com/) or on any mobile versions of our website and/or mobile applications (collectively, the “Site”) from third parties that provide Personal Information to us, or through other interactions with us.
  • How we protect the privacy of your Personal Information.
  • How we use that Personal Information.
  • How and under what circumstances we share that information.
  • How you can exercise certain rights in relation to the Personal Information we collect.

Customers in different states may be protected by state laws concerning consumer data protection. Our Virginia customers are afforded rights by the Viriginia Consumer Data Protection Act, while customers from Texas may be afforded rights by the Texas Data Privacy and Security Act, and customers from California may be afforded rights by the California Consumer Privacy Act (California residents should also refer to the section titled ’12. California residents’ of this Policy which should be understood as further rights in addition to those already described throughout the rest of this Policy).

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. When you use our toll road, submit information to us by email, by telephone or in person, through a response to a survey or through the Site, you consent to the collection and processing of your information as described in this Policy. If you do not agree with any part of this Policy, please do not use our Site or our toll road.

We may change this Policy from time to time. The “Effective Date” legend at the top of the page indicates when this Policy was last revised. Any changes will become effective when we post the revised Policy on the Site. Your continued use of the Site following these changes means that you accept the revised Policy. If we significantly change how we handle your Personal Information, we may provide more prominent notice or obtain your consent as required by law. If you do not wish to accept the changes, you should cease using the Site and our toll road.

1. Children under the age of 13

Our Site is not intended for, or targeted towards, children under the age of 13.

  • EMP will never knowingly solicit or collect personally identifiable information from a child under the age of 13 through the Site without verifiable parental consent.
  • If we discover that a child under the age of 13 has submitted personally identifiable information without verifiable parental consent, we will delete that information.

2. What Personal Information do we collect?

“Personal Information” is information that identifies, relates to, describes, or can be reasonably linked to, directly or indirectly, a particular individual or household. We collect Personal Information in order to provide you with the services and products we offer and/or to adequately answer your requests. In addition to obtaining your Personal Information from our Site and your use of our toll road, we obtain information such as your name and address from the Department of Motor Vehicles where the vehicle you drive is registered and from third-party vendors through skip tracing. If you participate in a survey or respond to a feedback request, we will collect the information that you provide in doing so and associated information. We collect information about people who visit our offices; this may include videos of you when you are in or near our offices.

Personal Information does not include information that we collect from publicly available sources. The categories of Personal Information we collect depend largely on circumstances, but typically could include the following:

  • Information by which you may be personally identified, such as your name, e-mail address, and any other identifiable information that you choose to submit to us.
  • Information collected when using our online services, about your internet connection, the equipment and browser you use to access our Site, usage details, the domain from which you link to the site, traffic data, and information collected through Cookies (as defined below) (“Usage Data”).
  • Information on your use of our toll road, including your license plate number, transponder number, vehicle information (including make, model, registration, etc.), trip details (including entrance & exit, tolls and fees charged), photos and videos of vehicles (which may include occupants in vehicles or people on the roadside), payment information (while we do not collect actual credit or debit card numbers, we do collect billing details and account balances).
  • Information we collect from various communication sources, including from our customer service center that may record and monitor phone calls and other communications for training, quality control, verification and compliance purposes. We may store certain communications you share directly with us in physical or digital form.

3. Why do we collect your Personal Information?

The Personal Information that we collect allows us to conduct our business. We attempt to only collect the Personal Information necessary to do so. These collection practices can typically be explained in the following way:

  • We collect Personal Information when you voluntarily submit Personal Information to us.
  • The majority of the Personal Information we collect, without your previous submission, occurs when you use our toll road. This information allows us to properly process toll trips and High Occupancy Vehicle (HOV) discounts.
  • By using our toll road, visiting our office and/or using this website, you consent to our collection of your trip data, including toll gantry entrance and exit information, and imaging, as applicable. EMP’s collection of this information is reasonably necessary for the proper functioning of our business activities, and such collection is done only to the extent allowed and/or required by law.

4. How do we collect your Personal Information?

We collect your Personal Information in the following ways:

  • Directly from you when you provide it to us (for example, when you submit a question, correspond with our Site by e-mail or other electronic message, or create an online account with us).
  • Automatically, as you navigate through our Site (see the section titled ’11. Cookies policy’ of this Policy).
  • Through various technologies when you use our toll road, including cameras.
  • From governmental road agencies.
  • Through the Department of Moror Vehicles and from other third parties through skip tracing.

5. How do we use your Personal Information?

Your Personal Information may be used as follows:

  • To provide you with services or information that you request from us.
  • To calculate and recover tolls and fees.
  • For customer service, security, to detect fraud or illegal activities.
  • To assist the enforcement of laws, and detect, prevent, and investigate any fraud or crime (or suspected fraud or crime).
  • For archival and backup purposes.
  • To better understand how you access and use our toll road and the Site, for the purposes of trying to improve the same, diagnose problems, administer our toll road and Site and respond to customer preferences.
  • To properly assist roadside assistance, contractors, and insurance providers involved in road incidents and with respect to any property damage caused by such incidents.
  • To comply with and/or enforce our Site Terms of Use, applicable laws, ongoing law enforcement agency investigations, or other applicable policies.
  • For address verification and billing purposes.
  • To the extent permitted by law, to carry out consumer, market, community and traffic research, compile demographics and perform other analysis so that we can develop and implement initiatives to improve our services, improve the design, construction and operation of our roads and identify people likely to be affected by or interested in our roads and services.
  • To the extent permitted by law, we may use some of your Personal Information for marketing purposes. We may contact you about our products and services or special offers that we think may be of interest to you. If we do, we will always give you an opportunity to opt out of any targeted marketing. If you do not wish to receive targeted marketing from us, you may opt-out by contacting us

6. When do we disclose your Personal Information?

We treat the Personal Information you submit to us as confidential. We may share Personal Information with other trusted companies or people to perform functions for which we engage them. We may disclose any Personal Information in our possession in the following manner:

  • If we are required to do so by law or we believe, in good faith, that such a disclosure is necessary to comply with the law, a court order or other government or law enforcement agency, to defend our rights or property, prevent financial loss or physical harm, or to respond to an emergency situation or protect the rights, property or safety of others.
  • With third parties who provide services on our behalf. These third-party vendors include Site administrators, vendors who help us analyze our Site’s performance (such as Google Analytics), call center operators, law firms, insurance providers, mail house/print house organizations, communications professionals, and vendors assisting in processing toll and HOV trips (the “Third-Party Vendors”).
  • With the Virginia Department of Transportation (“VDOT”), or other parties with whom we have contracted to provide services in connection with our project, if reasonably necessary to respond to your questions.
  • We may also authorize Third-Party Vendors to collect information on our behalf as necessary to maintain the functionality of our toll road and the Site.
  • To a purchaser or successor entity in the event of a sale or other corporate transaction involving some, or all, of our business.
  • EMP does not engage in the “Sale” of Personal Information, in other words EMP does exchange Personal Information with a third party for monetary or any other valuable consideration, nor rent any Personal Information to third parties and does not provide any information obtained through the Site to third parties for direct marketing purposes.

The following categories of information may currently be shared as described below:

  • Information by which you may be personally identified, such as your name, e-mail address, and any other identifiable information that you choose to submit to us. This information is shared directly with the following: Collection agencies and DMV lookup providers Courts and third parties that provide legal services to us. This information is also shared indirectly with parties that provide contractual services to us in connection with call center services and technical services. Indirectly means that they have access to such information while connecting securely to our systems, when performing services as part of our contracts, but we do not share it directly to their systems.
  • Information on your use of our toll road, including your license plate number, transponder number, vehicle information (including make, model, registration, etc.), trip details (including entrance & exit, tolls and fees charged), photos and videos of vehicles (which may include occupants in vehicles or people on the roadside), payment information (while we do not collect actual credit or debit card numbers, we do collect billing details and account balances). This information is shared directly with the following: Collection agencies and DMV lookup providers Courts and third parties that provide legal services to us. The information is also shared indirectly with the following due to us having a contract with them to provide the transactional systems and processing or to provide call center services. Indirectly means that they have access to the information while connecting securely to our systems when performing services as part of our contract, but we do not share it directly to their systems. In addition, license plate and transponder information is shared indirectly with third parties that provide us with cyber security and technical and maintenance services for our toll operating systems.
  • Information we collect from various communication sources, including from our customer service center that may record and monitor phone calls and other communications for training, quality control, verification and compliance purposes. We may store certain communications you share directly with us in physical or digital form. This information is not shared unless we receive a subpoena, or the customer specifically gives us consent to share it with a third party.
  • Toll gantry entrance and exit information for toll-billing purposes. This information is shared directly with the following: Collection agencies and DMV lookup providers, Courts and third parties that provide us with legal services. The information is also shared indirectly with third parties that provide contractual services to us in connection with call center services, technical services, cyber security and technical and maintenance services for our toll operating systems.
     

    Further, any of the foregoing information may be released if you give us consent to do so or if we are ordered to do so by a court or pursuant to a subpoena.

7. Security

We want you to feel confident about using our toll road, our Site, or any other services we may offer.

  • We implement a variety of physical, technical and administrative security measures to maintain the safety of your Personal Information.
  • The security of information transmitted through the internet can never be guaranteed. We thereby cannot warrant or guarantee 100% security of any information stored electronically and/or transmitted to us through the Site.
  • Any Personal Information collected pursuant to this Policy will be used only for the purposes described herein and retained as long as we believe may be necessary to achieve such purposes.
  • To the extent we provide your Personal Information to any third parties, we will request that they use reasonable security measures to protect your information.
  • Please note that, to the extent we use Google Analytics, we do not combine the information collected through the use of Google Analytics with Personal Information that we collect from you from other sources in an attempt to associate such information with you as an identifiable individual. Google’s ability to use and share information collected by Google Analytics about your use of the App is restricted by the Google Analytics Terms of Use and the Google Privacy Policy.

8. Accessing, correcting and/or deleting Personal Information we collect

We strive to maintain the accuracy of Personal Information collected. You may exercise certain rights in relation to your Personal Information:

  • You may request to access the Personal Information that we have about you (a “Request”) and you are entitled to a copy of your personal data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format.
  • We strive to maintain only accurate and up-to-date Personal Information, as such, you may Request to correct or delete any Personal Information we may have about you. Note that, despite a Request to delete parts, or all, of the Personal Information we collect about you, we may, in certain instances, need to retain Personal Information insofar as such is required, including to finalize transactions linked to your account, or for other legal or regulatory purposes.
  • Any Request for information made pursuant to the above will be provided to you free of charge, although, in certain instances, depending on the type of Request, we may charge a fee to cover administrative costs for complying with such Requests.
  • When a Request for Personal Information is made, we may need to take relevant measures in order to authenticate your identity.
  • EMP strives to answer Requests without undue delay, and in all cases within 45 days of receipt of a Request. We may need to extend the response period by an additional 45 days when reasonably necessary, taking into account the complexity and number of Requests received. If an extension is needed to respond to a Request, EMP will inform you of such within the initial 45-day period, together with the reasons for the extension.
  • If we decide to decline a Request, we will provide a justification for such decision as well as a way to appeal to such decision (the “Appeal”). Within 60 days of receipt of an Appeal, EMP will inform you in writing of any action taken or not taken in response to the Appeal including an explanation for such decision. If an Appeal is denied, you may contact the relevant Attorney General’s office, as further detailed in the below section titled ‘8. Relevant contact information’, to submit a complaint.
  • Any Request may be made by either contacting our customer service by telephone at: +1 (833) 643 2867, or through our website (https://ride66express.com/using-the-lanes/billing-and-customer-service/).
  • If you do not wish to receive communications from us, you may opt-out by contacting us. However, please note that EMP may continue to contact you as needed to respond to Requests or inquiries from you.

9. Managing “Do Not Track” signals

Some browsers have a Do Not Track (“DNT”) feature that lets you tell websites that you do not want your online activities tracked. When you choose to turn on the DNT setting in your browser, your browser sends a special signal to websites, ad networks, plug-in providers, and other web services you encounter while browsing to stop tracking your activity via Cookies or other tracking technologies. EMP does not track its website users over time and across third party websites and therefore does not respond to DNT signals.

10. Third-party links

The Site may contain links to websites maintained by third parties with which we have no affiliation. This Policy does not reflect the privacy practices of those sites, and you should consult the privacy policies of those sites to learn about their practices. A link to any third party site does not mean that we endorse it or the quality or accuracy of information presented on it. Please note that if you sign up for alerts in connection with our project, or register for an EZ-Pass, you are providing Personal Information directly to the Virginia Department of Transportation (“VDOT”). EMP does not collect or retain that information, which therefore is not handled in accordance with this Policy.

11. Cookies policy

We may utilize Cookies to gather data. Generally, we use Cookies to create a record of your identity and provide you with repeated access to your account information without the need to re¬-enter data (the “Cookies”). If you wish, you can set up your browser or mobile device in a way to refuse to accept Cookies. However, if you do so, you may be unable to access parts of the Website. To opt out of a Third-Party Vendor’s use of Cookies you may visit the Network Advertising Initiative opt-out page.

12. California residents

For those California residents that interact with us in any way, please refer to the below regarding how we may collect and use your Personal Information:

  • If you provide us with sensitive personal information, you may limit the use of your sensitive personal information, as permitted under the law, and to the extent our services can still be performed as needed, by contacting us through our website (https://ride66express.com/using-the-lanes/billing-and-customer-service/) or by contacting our customer service at: +1(833)643-2867.
  • We may disclose the Personal Information we collect, as further detailed in the above section titled ‘2. What Personal Information do we collect?’, with Third-Party Vendors and affiliates for business purposes. These Third-Party Vendors provide services including Site administration, call center operations, legal services, mail house/print house services, communication services, and services related to the processing of toll and HOV trips. We share Personal Information with affiliates to the extent necessary to ensure the proper functioning of our project.
  • Although we do not engage in the Sale of Personal Information to third parties (third parties we share Personal Information with are as described directly above and in the section titled ‘6. When do we disclose your Personal Information?’), we may share your Personal Information with third parties. If you would like us to stop sharing such information, you have the right, to the extent acceptable by law, to opt-out of such disclosures by contacting us through our website (https://ride66express.com/using-the-lanes/billing-and-customer-service/) or by contacting our customer service by telephone at: +1 (833) 643 2867.
  • EMP does not, without adequate consent, share or engage in the Sale of Personal Information if we have actual knowledge that you are less than 16 years of age.

Note that fulfillment of the request may not ensure complete or comprehensive removal (e.g., if the content or information has been reposted by another user).
